% 08.11.2016 Present writ petition has been filed seeking a direction to respondent No.1-DDA and respondent No.2-EDMC to demolish the unauthorised and illegal construction carried out by the owners of Flats No.24 and 27, Him Versa Apartments, I.P. Extension, Patparganj, Delhi. It has been averred in the petition that the petitioner is the owner of Flat No.18, Him Versa Apartments, I.P. Extension, Patparganj, Delhi. It has further been averred that residents of Flats No.24 and 27 have constructed a lift for personal use on a public land/ common area. On 23rd August, 2016, learned counsel for EDMC had stated that the flat owners had applied for regularisation of the lift. On the said date, EDMC was directed to decide the application for regularisation within a period of four weeks.
Today learned counsel for EDMC has handed over a copy of letter dated 28th October, 2016, by virtue of which the application of the owners for regularisation of lift has been rejected. The same is taken on record. Learned counsel for EDMC, on instructions of Mr.Anuj Kumar, J.E., EDMC, assures and undertakes to this Court that the unauthorised and illegal construction carried out by the owners of Flats No.24 and 27, Him Versa Apartments, I.P.
Extension, Patparganj, Delhi shall be demolished/removed in accordance with law within a period of six weeks. The assurance and undertaking given by learned counsel for EDMC is accepted by this Court and the EDMC is held bound by the same. Accordingly, the present writ petition stands disposed of.
