The present petition has been filed seeking modification of order dated 19.11.2024 whereby the learned Chief Judicial Magistrate vide order dated 19.11.2024 granted permission to travel abroad for a period of three months starting from 22.11.2024 subject to furnishing a personal bond in the sum of Rs.25,00,000/- alongwith certain other conditions. Learned counsel submits that earlier also similar permission was granted by learned ACMM vide order dated 16.09.2022 on furnishing an FDR of Rs.5,00,000/- with certain other conditions. Learned counsel submits that the said order was challenged before this Court by the petitioner in Crl.M.C. No. 49975/2022 and this Court vide order dated 16.11.2022 taking into account the condition in the peculiar circumstances set aside the order dated 16.09.2022 and reduced the amount of FDR to a sum of Rs.1,00,000/-.

Learned counsel submits that subsequent to it again on 19.12.2022, learned ACMM while granting permission directed to furnish the FDR in the sum of Rs.5,00,000/- with certain other conditions. 4.
Learned counsel submits that this order was challenged by the petitioner in Crl.M.C No. 296/2023 before this Court and vide order dated 17.01.2023 this Court reduced the sum to Rs.1,00,000/-. 5.
Learned counsel for the respondent submits that they have filed a reply, however, the same is not on record. The hard copy of the reply has been shared.

It has been submitted that now there is a change in circumstances as a complaint has been filed against the petitioner. 7.
That in view of the order of this Court in Crl.M.C. No. 296/2023 dated 17.01.2023 and Crl.M.C No. 4975/2022 dated 16.11.2023, the impugned order is liable to be modified to the extent that the petitioner shall furnish an FDR in the sum of Rs.1,00,000/- with an undertaking to report back before the Court on 28.02.2025 failing which the said amount would stand forfeited without giving any further opportunity and the FDR shall be released to the applicant.
