% 23.02.2016 IA 1679/2016 This is an application filed by the plaintiff for refund of the court fee. Learned counsel for the plaintiff /applicant states that the parties to this present suit had settled their inter se disputes vide deed of settlement dated December 10, 2015 and the suit was decreed in terms of the deed of settlement on December 14, 2015. He also states that in view of the fact that the suit has been decreed in terms of the deed of settlement, the plaintiff is entitled to refund of the court fee in terms of Section 16A of the Court Fees Act as applicable to Delhi.

Noting the submissions made by the learned counsel for the plaintiff, and the fact, the suit was at the stage of service on Defendant No.4, and also

it has not reached the stage of recording the evidence, the plaintiff shall be entitled to refund of court fee in terms of Section 16A of the Court Fees Act. The application is disposed of.
