O R D E R

The present proceedings are instituted on behalf of the petitioners seeking quashing of FIR No. 1389/2021 registered under Sections 308/34 IPC at P.S. Rani Bagh, Delhi on the ground that the parties have amicably settled their disputes.

As per the allegations levelled in the FIR, petitioners gave beatings to respondent No.3 on the pretext that he misbehaved with their female associate, Saloni.

Learned APP for the State, on instructions, submits that the petitioners are the only accused person and respondent Nos.2 and 3 are the complainants/victims in the present case. in motion and the allegations are of grave nature, some cost may be imposed upon the petitioners.

Learned counsel for the petitioners submits that the petitioners and respondent Nos. 2 and 3 have amicably settled their disputes vide MOU/Settlement Agreement dated 19.11.2024, a copy of which has been placed on record.

It is informed that cross FIR No. 1386/2021 registered under Section 354 IPC at P.S. Rani Bagh, has also been quashed by this Court vide today's order passed in CRL.M.C. 9785/2024.

Petitioners, who are present in Court, have been identified by their counsel as well as the I.O. Respondent Nos. 2 and 3 are also present in Court and identified by the I.O. Petitioners have shown remorse for their conduct and undertake not to repeat the same in future. 7.
Respondent Nos. 2 and 3 state that they have entered into the settlement with the petitioners out of their own free will, volition and without any coercion. They further state that they have no objection if the present FIR and consequent proceedings are quashed. 8.
The parties shall remain bound by the statements made in Court today.

In view of the above facts and considering that no useful purpose will be served in continuance of the proceedings, it is directed that the aforesaid FIR and the consequent proceedings arising therefrom are hereby quashed, subject to payment of cumulative cost of Rs.10,000/- to be deposited with 'Avlamban Fund Scheme, 2024' (State Bank of India, Tis Hazari Branch, Delhi, Account No. 43599660056; IFSC SBIN0000726 & MICR Code 110002126).

Proof evidencing receipt of deposit shall be filed with the I.O. as well as in Court failing which, the I.O. shall be at liberty to move appropriate application.
