The present petition challenges the order dated 06.11.2024 passed by ACJ/ARC, North West District, Rohini Court in CS SCJ 39/2023. 2.
The learned counsel for petitioner submits that in CM (M) 3662/2024, filed by petitioner challenging the order dated 26.02.2024 of the learned Trial Court, this Court had issued directions to the Trial Court to defer the hearing to a date subsequent to the one given by this court. 3.
While fixing the next date as 13.12.2024, this court had also issued orders for maintaining status quo with respect to the FDRs in question. It is also submitted that Trial Court has since rejected the suit under Order 7 Rule 11 (d) CPC on 21.10.2024.

Thereafter the petitioner filed an application under Section 151 CPC for recall of order dated 21.10.2024, which is now listed for arguments on 22.01.2025.

The only prayer of petitioner is that directions be issued to the trial court for disposal of such application before 13.12.2024 i.e. date fixed before this Court.

Since CM (M) 3662/2024 is listed before this Court on 13.12.2024, petition is allowed with directions to the learned Trial Court to make endeavour to dispose of the application before the said date.
