% 29.03.2017 None has been appearing for the appellant and the appeal has been pending for hearing. Vide order dated 17th October, 2016 this Court noted that by the impugned judgment of conviction three more accused were convicted besides the appellant, however as per the cause list no other appeal appears to have been filed by the co-convicts. Mr. Neeraj Bhardwaj, Advocate to whom notice was issued as none was appearing sought discharge stating that he was never the counsel for the appellant.

A report was sought from the Superintendent Tihar Jail. As per the report of the Superintendent Tihar Jail only co-convict Anand @ Rikku filed an appeal being Crl.A. 515/2012 which is pending hearing before this Court. CRL.A. 1007/2011

Sentence of Anand @ Rikku was suspended by this Court. However, as per the nominal roll the appellant Rajesh @ Sonu S/o Sant Ram was released from Central Jail Tihar No.5 on 7th July, 2015 after expiry of sentence. This appears to be probably the reason that nobody is pursuing the appeal. Consequently, the appeal is disposed of as not pressed. MUKTA GUPTA, J MARCH 29, 2017 'ga'
