This is a petition under Section 528 of BNSS for quashing of FIR No. 506/2025 under Section 110/115(2)/126(2)/3(5) registered at P.S. Swaroop Nagar, Delhi.

Learned counsel submits that both parties have come to an amicable settlement. It is stated that they are residents of same locality and the dispute accrued on account of property dispute.

Learned APP has vehemently opposed the quashing of the FIR submitting that the investigation is still at an initial stage. The petitioners are not cooperating in the investigation and are evading their arrest. As per the allegation in the FIR, the petitioners surrounded the complainant. They were armed with lathis, dandas and rods. They abused the complainant and his son Naveen and when they resisted, all of them attacked the complainant and his son. Javed gave danda blow on the head of Naveen due to which he fell down and started bleeding. Upon seeing the incident, the brother of the complainant and his son came to their rescue but they were also beaten resulting injuries to the nephew of the complainant. 5.
Learned APP has placed on record the status report along with the photographs which shows severe head injuries. It has been submitted that the injuries of such nature that could have endangered the life of the victim. 6.
The case is at an initial stage of investigation. The opinion regarding the nature of injuries is still not obtained as the victim is still under treatment.

Considering the fact that the case is at an initial stage of investigation inasmuch as opinion regarding the nature of injuries is still not received, in my view, the petition is pre-mature and is therefore dismissed.
