In view of the decision passed by this Court in the case of Mr. Rakesh Mediratta v. Asian Hotels (North) Limited & Anr. dated 13.08.2025 in CS(COMM) 66/2024, learned counsel appearing for the plaintiffs seeks liberty to withdraw the instant civil suit with further liberty to undertake the pre-mediation process as contemplated under Section 12A of the Commercial Courts Act, 2015 and thereafter, to take appropriate recourse in accordance with law.

With the aforesaid liberty, the civil suit stands dismissed as withdrawn. All rights and contentions of the parties are left open. 3.

The entire Court fee is directed to be refunded to the plaintiffs.
