The present petition has been filed by the petitioner under Section 483 of BNSS, 2023 seeking regular bail in connection with FIR No. 632/2025 under Section 333/115(2)/351(3)/3(5) of BNS registered at PS Dabri. 4.
The case of the prosecution as borne out from the status report handed over across the bar is of unlawful trespass, physical assault, criminal intimidation and issuing of death threats while brandishing a weapon. The status report is taken on record.

Mr. Shivansh Maini, learned counsel appearing on behalf of the petitioner submits that in the FIR, no specific role has been attributed to the petitioner. In view of the above, issue notice.

Mr. Ajay Vikram Singh, learned APP appearing on behalf of State accepts notice.

On a pointed query posed by the Court as to the role of the petitioner, he states on instructions from the IO, that no specific role has been attributed to the petitioner, but the petitioner is visible in the CCTV footage along with the other co-accused persons.

On further being queried, he fairly states that the petitioner is not required for any further investigation.

Having regard to the nature of allegations, no specific role having been attributed to the petitioner, and the custody period of more than one month, this Court is of the view that the petitioner has made out a case for grant of regular bail.

Accordingly, the petitioner is admitted to regular bail subject to him furnishing a personal bond in the sum of Rs.25,000/- with one surety of the like amount to the satisfaction of the learned Trial Court, further subject to the following conditions:
(a) The petitioner shall appear before the Court as and when the matter is taken up for hearing.
(b) The petitioner shall provide mobile number to the IO concerned which shall be kept in working condition at all times and he shall not change the mobile number without prior intimation to the Investigating Officer concerned.
(c) The petitioner shall not come in contact with the witnesses or tamper with any evidence.

It is clarified that the observations made hereinabove are only for the limited purpose of deciding the present bail application and the same shall not be construed as an expression of opinion on merits of the case. 13.
