Petitioner/counter-claimant has assailed judgment and order dated 19.08.2025 of the learned Appellate Court, whereby the appeal against partial allowing of application under Order XXXIX Rule 1 & 2 CPC was dismissed. Broadly speaking, the learned trial court partially allowed the interim injunction application thereby restraining the defendant/respondent from creating third party interest in the subject property but disallowed the interim injunction application as regards relief seeking to restrain the respondent/defendant from interfering with possession of the petitioner/ counter-claimant over the subject property. The reason for denying the relief related to possession, as recorded in the impugned order is that vide paragraph 20 of the counterclaim, the present petitioner/counter-claimant herself pleaded that the suit property has been locked by the present respondent.

After addressing partly, learned counsel for petitioner/counterclaimant on instructions seeks permission to withdraw this petition as he intends to file an application for amendment of counterclaim in order to clarify the status of possession over the subject property. 3.

Accordingly, the petition and the accompanying applications are dismissed as withdrawn.
