The present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 20231 (corresponding to Section 482 of the Code of Criminal Procedure, 19732) seeks quashing of FIR No. 29/2025 dated 03rd March, 2025, registered under Sections 406, 420 and 120B of the Indian Penal Code, 18603 at P.S. Economic Offences Wing, Delhi. 2.
The Petitioners, who have been named as accused in the aforenoted FIR, contend that they are innocent of the allegations levelled against them. It is submitted that the dispute with the Complainant is purely civil and 1 "BNSS"

contractual in nature and does not warrant criminal prosecution. Nonetheless, counsel for the Petitioners states that they are ready and willing to join investigation.

Mr. Hitesh Vali, APP for the State, on instructions from the Investigating Officer, submits that the matter is at an initial stage and the investigation has only recently commenced. The present petition is premature and not maintainable at this stage. Mr. Vali further submits, on instructions, that no custodial interrogation of the Petitioners is presently required. However, should the need arise during the course of investigation, appropriate notice shall be issued to the Petitioners. 4.
In light of the foregoing, counsel for the Petitioners seeks leave to withdraw the present petition with liberty to take recourse to other appropriate remedies in accordance with law.

It is clarified that this Court has not examined the matter on merits, and all rights and contentions of the parties are left open. Further, the withdrawal of the present petition shall not be construed as an expression of any opinion by this Court on the merits of the case. 6.
