Petition under Section 528 B.N.S.S. has been filed on behalf of the Petitioners for quashing of FIR No.0485/2018 under Sections 323/341/34 IPC, registered at PS: Burari, Delhi and all consequential proceedings emanating therefrom, in terms of Compromise Deed dated 01.09.2025. 2.

Learned APP for the State appears on advance Notice. 3.

Perusal of record shows that present FIR was registered on 26.10.2018 and as per learned APP for the State, on instructions, no Chargesheet has been filed till date. The offences are under Sections 323/341/34 IPC, which are essentially with maximum imprisonment of one year, the limitation for filing the Chargesheet for the same was also one year. 4.

There is no explanation forthcoming as to why no Chargesheet has been filed till date and why the stakeholders, whether the accused or complainant, are being driven from pillar to post to find justice. 5.

for quashing of the FIR. Petitioner No.1 and Complaint are present in person, while other Petitioners are appearing through VC, It is submitted that they are all relative and it was a fight amongst the family members, which they have amicably settled with the intervention of family members, relatives and well wishers vide Compromise Deed dated 01.09.2025. 6.

The parties have been identified by the IO and they submit that they have arrived at the settlement without any force, coercion and undue influence and pressure and they have signed the Compromise Deed dated 01.09.2025 with their wish and will.

Learned Counsel for Petitioners submits that the parties have been happily living together and have no grievance against each other. Since both the parties do not want to pursue the proceedings in FIR, the present Petition be allowed and FIR No.0485/2018 be quashed.

In view of Compromise Deed dated 01.09.2025, present Petition has been filed.

In view of the fact that the FIR in question was premised upon a dispute between relatives, which has been amicably resolved in terms of Compromise Deed dated 01.09.2025. Considering the fact that parties have been living peacefully and have no objection to the quashing of FIR, no fruitful purpose would be served in continuing with the proceedings arising out of the FIR. 10.

Consequently, FIR No.0485/2018 under Sections 323/341/34 IPC, registered at PS: Burari, Delhi and all consequential proceedings emanating therefrom are quashed.

However, it is observed that this is one of the many cases, which have come to the notice of this Court, where despite registration of FIR, Chargesheets are not being filed within stipulated time. It is imperative that the DCP of concerned District must be a little more pro-active and supervise the work at different Police Stations within its jurisdiction, to ensure that such like incidents do not happen. If there are FIRs long pending without Chargesheet being filed in the Court, the DCP concerned must look into the functioning of the Police Stations. 13.

This Court has refrained from passing any strictures against the State functioning, however, it is directed that DCP of concerned District must enquire into the functioning of the Police Stations within its jurisdiction. 14.

The Petition along with pending Application is disposed of. 15.

A copy of this Order be forwarded to Commissioner of Police, Delhi for information.
