Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ('BNSS') has been filed on behalf of the Petitioners, for quashing of FIR No.0398/2022 under Sections 380/454/411/34 IPC, registered at PS: GTB Enclave, Delhi and all consequential proceedings emanating therefrom, in terms of Settlement Deed dated 25.09.2025.

Brief facts of the case are that Petitioner No.1 was employee in the Godown of Respondent No.2 / Complainant and had stolen aluminum frames The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
and sheet and GI Sheets from the godown and sold the same to Petitioner Nos.2 and 3.

Recovery of all stolen articles was made thereafter and now parties have amicably settled all their disputes.

It is further submitted that on 12.09.2022, on Complaint of Respondent No.2, FIR No.0398/2022 under Sections 380/454/411/34 IPC was registered at PS: GTB Enclave, Delhi.

It is submitted that present FIR was a consequence of steeling the material by Petitioner No.1/ex-employee of Respondent No.2 and selling the same to Petitioner Nos.2 and 3. It is stated that the Petitioners and Respondent No.2 have amicably settled all the disputes and differences between them vide Settlement Deed dated 25.09.2025.

The parties are present in the Court and have been identified by the IO. The parties submit that they have arrived at the settlement without any force, coercion and undue influence and pressure and they have signed the Settlement dated 25.09.2025 with their wish and will. 10.
Learned Counsel for Petitioners submits that the parties have no grievance against each other. Since Respondent No. 2 has already made a statement before the Court that he does not want to pursue the proceedings in FIR, the present Petition be allowed and FIR No.0398/2022 be quashed. 11.
In view of Settlement Deed dated 25.09.2025, present Petition has been filed.

In view of the fact that the FIR in question was premised upon steeling of some article by Petitioner No.1 from godown of Respondent No.2, which have been recovered and the matter has been amicably resolved in terms of Settlement Deed dated 25.09.2025. been living together for last two months and Respondent No.2 has also given no objection to the quashing of FIR, no fruitful purpose would be served in continuing with the proceedings arising out of the FIR. 13.
Consequently, FIR No.0398/2022 under Sections 380/454/411/34 IPC was registered at PS: GTB Enclave, Delhi and all consequential proceedings emanating therefrom are quashed.
