The present writ petition has been filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, read with Article 226 of the Constitution of India, seeking the following reliefs:- a) Issue a Writ, Order, or Direction in the nature of Habeas Corpus commanding Respondents Nos. 1 to 3 to produce the body of the Detenu, Shri Rinku Kumar, before this Hon'ble Court without delay, and upon verification of the circumstances, set him at liberty if found to be under illegal restraint, confinement, or detention;

b) Issue Rule Nisi to the Respondents to appear and show cause as to why the prayed relief should not be granted and made absolute, with an opportunity for them to file counter-affidavits within a short timeframe;

senior officers (not below the rank of Deputy Commissioner of Police), under the direct supervision of this Hon'ble Court, to conduct a comprehensive, time-bound investigation (within a stipulated period, say 30 days) into the Detenu's disappearance, including but not limited to: detailed analysis of mobile CDRs, location data, and financial transactions; interrogation of Respondents Nos. 2 and 3 and other witnesses; forensic examination of relevant sites and devices; and coordination with Uttar Pradesh Police for inter-state assistance;

d) Direct immediate search and seizure operations at the residential, agricultural, and ancillary premises of Respondents Nos. 2 and 3, including any properties in Village Dangua and Village Dhoa, District Mainpuri, Uttar Pradesh, to recover evidence, trace the Detenu, or uncover clues, with mandatory videography, independent witnesses, and compliance reports to this Court to ensure transparency and prevent tampering;

e) Award exemplary costs and compensation to the Petitioner for the mental trauma, emotional distress, and expenses endured due to the Respondents' actions and inactions, and impose penalties on delinquent officials if negligence, malafide, or complicity is established upon inquiry;

The detenu, namely, Shri Rinku Kumar, is present in person. 3.

Upon being enquired, he submits that he has a strong apprehension that the petitioner may cause harm to him if he chooses to stay with her. The detenu has also declined to explore any possibility of amicable settlement through mediation. He submits that, presently, he is living happily with the two children of his deceased brother and his deceased sister-in-law and that he does not wish to stay with the petitioner.

Such apprehension is resisted by the petitioner. 5.

Fact, however, remains that it is evident that the relationship between the detenu and the petitioner is severely strained. 6.

Since Shri Rinku Kumar is present in person, in the given facts and circumstances of the case, no further orders are required. 7.
