% 30.09.2016 Crl. M.A. No.15454/2016 Exemption allowed, subject to all just exceptions. The application stands disposed of.

Crl. M.A. No.15453/2016 Issue notice. Notice is accepted on behalf of the State and the injured. The complainant has expired and the injured is present in court today. The appellant has moved this application to seek acquittal in the case since disputes between the appellant and the injured have been resolved in mediation. The settlement agreement dated 09.09.2016 duly signed by the

parties, the learned mediator as well as counsel for the parties is placed on record.

Under the settlement, the appellant has agreed to make a payment of Rs.3.75 lacs. Out of that amount Rs.1.25 lacs has already been paid and the balance amount of Rs.2.50 lacs is tendered in court today to the injured by way of cheque no.255580 dated 30.09.2016 drawn on United Bank of India. Learned counsel for the appellant, on instructions, states that the said cheque shall be honoured upon presentation.

The injured, who is present in court, states that he is satisfied and does not wish to pursue the matter any further against the appellant. In view of the aforesaid, Mr.Katyal fairly does not oppose the application.

Accordingly, the impugned judgment is set aside and the appellant stands acquitted.

The application stands disposed of.
