CRL.M.A. 2841/2026 By way of the present application filed under section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023, the petitioner seeks 'exemption from surrendering' for a period of 03 months, upon expiration of the extension of parole granted to him vidé order dated 13.01.2026 in case FIR No. 611/2001 registered at P.S.: Badarpur andin case FIR No. 261/2001 registered at P.S.: Seemapuri, Delhi. 2.

04-week extension of parole beyond the 04-week parole granted vidé order dated 09.12.2025. Pursuant to the parole first granted, the petitioner was released from custody on 19.12.2025; and has been out ever-since.

The extended parole is stated to be expiring on 12.02.2026. 4.

Ms. Bhandari argues, that subsequent to order dated 13.01.2026, the surgery of the petitioner's mother has been scheduled for 18.02.2026 at the Max Super Speciality Hospital, Shalimar Bagh, where she is to undergo bilateral total knee replacement surgery. 5.

For the aforesaid reason, the petitioner seeks a second extension of parole, having been out of jail for about 06 weeks. 6.

In para 17 of order dated 13.01.2026, this court had observed that no further extension of parole would be granted to the petitioner, on the basis on which parole was first granted in the present proceedings. 7.

In view of the observation made in order dated 13.01.2026; and the fact that the petitioner has already availed extension of parole; and has been out on parole for about 06 weeks, this court is not inclined to allow any further extension.

The present application is accordingly dismissed. W.P.(CRL) 3690/2025 9.
