O R D E R

The present application is filed by the applicant seeking interim bail in FIR No. 448/2021 dated 03.09.2021, for offence under Section 363 of the Indian Penal Code, 1860 ('IPC') registered at Police Station Sangam Vihar on the ground of serious medical condition of the mother of the applicant, namely Smt. Prabhawati Devi.

It is submitted that the applicant's mother is admitted in the hospital since past one month and is unconscious and is suffering from internal haemorrhages. The only person taking care of her mother is the applicant's sister who is now engaged. 3.
It is further urged that the applicant, being the eldest child, is required to take care of her mother, who might be on her death bed. It is also urged that there is no one to take of the minor children of the applicant.

The learned Additional Public Prosecutor for the State, on instructions, submits that the medical condition of the applicant's mother has been verified. He submits that the applicant's mother suffered a brain stroke and left side of her body is completely paralysed.

Considering the aforesaid discussion and medical status of the mother of the applicant, this Court is inclined to take an empathetic approach in the present case.

Though it is stated that the applicant's sister is there to take care of her mother, however considering the totality of circumstances and that the engaged sister is the only person who is taking care of the mother and the two minor children, purely on humanitarian grounds, the applicant is directed to be released on interim bail for a period of one week, if not in custody in any other case, on furnishing a personal bond for a sum of ₹20,000/- with two sureties of the like amount, subject to the satisfaction of the learned Trial Court/ Link MM/ Duty MM, on the following conditions:
a. The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case or tamper with the evidence of the case, in any manner whatsoever; b. The applicant shall, upon her release, provide the address where she would be residing after the release and shall not change the address without informing the concerned IO/ SHO;

d. The applicant shall not leave the boundaries of the country without informing the concerned IO/SHO; e. The applicant shall speak every day in the evening to the Investigating Officer, during the period of her release, to mark her presence.

The applicant is directed to surrender before the concerned Jail Superintendent immediately on the expiry of period of interim bail.

The present bail application is allowed in the aforesaid terms.
