CRL.M.C. 1270/2017 This is a petition under Section 482 Cr.P.C. filed on behalf of the petitioner for setting aside the order dated 19.01.2017 passed by the Court of ACMM/SE, Saket Courts, New Delhi and for release of vehicle bearing No.DL-1L-T 6583 on superdari in case FIR No.3/2017, under Sections 279/323/34 IPC, P.S. Badarpur, Delhi to the petitioner. Learned counsel for the petitioner submits that vide the impugned order, the learned ACMM has directed the petitioner to deposit a sum of

Rs.2 lacs in Court for release of vehicle on superdari. Counsel further submits that the amount so ordered to be deposited by the Trial Court is too harsh and the petitioner is a poor person having no money and the alleged accident did not hit any person or caused any injury to any other person and submits that the amount so asked to be deposited may be reduced. In view of the submissions made by counsel for the petitioners, the impugned order is modified to the extent that the amount of Rs.2 lakhs. ordered to be deposited by the petitioner in Court is reduced to Rs.1,000/-. However, the superdarinama to be executed shall be in the sum of Rs.1.5 lakh only. Rest of the order shall remain the same. The present petition is allowed and stands disposed of in the above terms.

Copy of this order be given dasti to the petitioner, as prayed. LCR be sent back along with one copy of this order.
