Mr. Deepak Chopra, who, appears for the respondent, says that reply filed in OMP (I) (COMM) 29/2018 is relied upon by the respondent in respect of ARB. P. 243/2018.

1.1 The said statement is taken on record.

After some arguments, learned counsel for the parties are agreed, that captioned petitions can be disposed of based on the following directions:- (i) Mr. Pradeep Chaddah, Former District & Sessions Judge, Delhi (M) 9910384665, is appointed as an Arbitrator in the matter. (ii) The rules and fee schedule of the Delhi International Arbitration Centre (DIAC) will be applicable to the arbitration proceedings. Proceedings will be concluded under the aegis of DIAC. (iii) The petition filed under Section 9 of the Arbitration and Conciliation Act, 1996 (in short "1996 Act") will be treated by the learned Arbitrator as the petition under Section 17 of the 1996 Act. (iv) Interim order dated 21.02.2018 will continue to operate, however, learned Arbitrator will have liberty to either confirm, vacate or even vary the order.

The Registry will dispatch a copy of this order to the learned Arbitrator.
