This suit is instituted on behalf of the Plaintiff seeking a decree of permanent injunction restraining the Defendants and all others acting on their behalf from using the impugned trademark/trade dress MICROTONE STETHOSCOPE/ and/or any other deceptively similar mark in relation to any surgical equipment and medical appartus products, amounting to infringement of Plaintiff's registered trademarks MICROTONE STETHOSCOPE/ and , amongst other reliefs.

High Court Mediation and Conciliation Centre, where they have amicably resolved their inter se disputes and a Settlement Agreement has been executed on 25.02.2026, incorporating the terms of settlement. Copy of the Settlement Agreement has been placed on record. 3.
In light of the settlement, counsel for the Plaintiff submits that the suit be decreed in favour of the Plaintiff and against Defendant No. 1, in terms of the Settlement Agreement.

Court has perused the terms of settlement and finds the same to be lawful. Accordingly, the suit is decreed in terms of the Settlement Agreement, which shall form a part of the decree and bind the parties thereto.

Registry is directed to draw up the decree sheet. 6.
Suit is disposed of along with pending applications. 7.
Plaintiff is held entitled to refund of entire court fees in accordance with Court Fees Act, 1870.
