Learned counsel for the respondent no.1 submits that the respondent no.1 is neither using nor is willing to use the subject mark 'SANTROGERMINA'in the present petition and has no objection if the present petition is allowed in terms of the reliefs sought therein. 2.

As such, the present petition is allowed and accordingly the Trademark 'SANTROGERMINA'registered under No. 5841045 in Class 5 is directed to be removed from the register of the Trade Marks. 3.

Learned counsel for the respondent no.2 is directed to intimate the Registrar of Trade Marks about the same. A copyof the present order be also sent to the respondent no.2 within a period of four weeks. 4.

Accordingly, the present petition is allowed and disposed of. SAURABH BANERJEE, J.
