This writ petition is filed on behalf of the Petitioner under Article 226 of the Constitution of India seeking the following reliefs:- "(a) issue a declaration declaring that the demolition action taken by the respondents as detailed above is bad in law (b) issue a writ of prohibition prohibiting the respondents from taking possession of the petitioner's land i.e. land measuring 8 bighas and 2 biswas in Khasra No.520, Village, Kilokari, Delhi and (c) permit the petitioner to raise the boundary walls on petitioner's land i.e. land measuring 8 bighas and 2 biswas in Khasra No.520, Village, Kilokari, Delhi and"

Learned counsel for the Petitioner submits that DDA has filed an affidavit stating therein that DDA does not intend to take possession of Khasra No. 520 admeasuring 8 Bigha 2 Biswa in Village Kilokri, which is the subject matter of the present petition, from the Petitioner and in light of this, the grievance ventilated in the present petition stands redressed. Ms. Prabhsahay Kaur, learned Standing Counsel for DDA submits that albeit a stand is taken in the affidavit that there is no intent to dispossess the Petitioner from the subject land, but this is subject to a caveat that DDA shall keep watch and ward over the land being a part of the Flood Plains of river Yamuna falling in 'O Zone', pursuant to this responsibility being cast on DDA by National Green Tribunal.

Responding to this, counsel for the Petitioner submits that Petitioner shall not undertake any activity in the subject land which is impermissible in the 'O Zone' area including commercial activity and shall file an affidavit of undertaking to this effect.

In light of the affidavit dated 25.04.2025 filed by DDA stating that Petitioner will not be dispossessed from the subject land, no further order is required to be passed in this writ petition. Needless to state that DDA will be entitled to keep watch and ward over the subject land as it falls within the 'O Zone'. Undertaking of the Petitioner that he shall not carry out any impermissible activity including commercial activity on the subject land is taken on record and accepted. Petitioner has been warned of the consequences of violating the undertaking given to the Court. Affidavit of undertaking shall be filed within four weeks from today, with advance copy to counsel for DDA.

Writ petition is disposed of with liberty to DDA to seek revival of the writ petition in case the undertaking is not filed by the Petitioner within four weeks. Pending application stands disposed of.
