The petitioner has been awarded a contract for three parking sites at Lajpat Nagar Main Market, New Delhi.

According to the petitioner, one of these sites has been withdrawn by the Municipal Corporation of Delhi ["MCD"] on 20.06.2024, for which the monthly license fee was also reduced. In respect of the other two sites, the petitioner is unable to collect the parking charges as the shopkeepers in the area are refusing to pay.

Although various reliefs have been sought in this writ petition, Mr. Shatadru Chakraborty, learned Senior Counsel for the petitioner, submits W.P.(C) 16671/2024 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. that the petitioner would be satisfied with a direction that various representations filed by him for consequent reduction in the monthly license fee be considered by the MCD.

Mr. Tushar Sannu, learned Standing Counsel for MCD, who appears on advance notice submits upon instructions that the representations are being considered.

The writ petition is disposed of in terms of the aforesaid submissions of MCD. It is made clear that the substantive remedies of the petitioner are contractual in nature. It is open to the petitioner to seek appropriate orders, in accordance with law, in the event the matter is not resolved to his satisfaction by the MCD.

It is also made clear that this Court has not commented upon the merits of the matter, and all rights and contentions of the parties are left open.
