O R D E R

This is a petition seeking regular bail in FIR No. 113/2024 dated 02.04.2024 filed under Sections 394/397/308/506/34 of IPC registered at PS Jafrabad.

As per the FIR, the petitioner hit the complainant with the brick and snatched his gold chain.

The petitioner was arrested on 01.06.2024 and as of today, the petitioner has been in custody for a period of 6 months 20 days. 4.

In the present case, chargesheet has already been filed and there is another FIR against the petitioner but the he is already on bail in those offences.

Injuries suffered by the complainant are opined to be simple in nature. Also, there is no recovery from the petitioner. The petitioner is still an under trial prisoner and the charges against the petitioner are yet to be proved. 6.

In view of the above facts and circumstances as noted above and the period of incarceration undergone, I am inclined to allow the petition. conditions:

a) The petitioner shall furnish a personal bond in the sum of Rs. 10,000/- (Rupees Ten Thousand Only) with one surety of the like amount to the satisfaction of the concerned Trial Court; b) The petitioner shall join investigation as and when called by the concerned IO, and the petitioner shall appear before the concerned Court as and when the matter is taken up for hearing; c) The petitioner shall provide his mobile number to the concerned IO, which shall be kept in working condition and switched on at all times. The petitioner shall also provide his permanent residential address and in case of change of residential address or contact details, the petitioner shall promptly inform the same to the concerned IO as well as to the concerned Court; d) The petitioner shall not leave the country without permission of the concerned Court during the bail period and surrender his passport, if any, at the time of release before the concerned Court;

e) The applicant shall report to the local Police Station on the first Monday of every month;

f) The petitioner shall not directly/indirectly try to get in touch with any prosecution witnesses or tamper with the evidence. 7.

The petition is disposed of.
