BAIL APPLN. No.389/2017 Notice. Learned APP accepts notice. Petitioner seeks interim bail for a period of one month on the ground that his mother has expired and he has
to perform last rites. It is not in dispute that mother of the petitioner expired on 23rd February, 2017 and cremation has taken place on 24th February, 2017.
It is submitted that Terahvin is scheduled for 7th March, 2017. Petitioner has also to go to Haridwar to perform last rites. Learned APP has opposed the grant of interim bail to petitioner. It is contended that petitioner along with co-accused had looted `45 lacs, jewellery and property documents from the complainant. `1.85 lacs has been recovered from the petitioner out of the looted amount. It is further submitted that co-accused is absconding. In case petitioner is released on interim bail, it will affect the arrest of co-accused. Petitioner was also involved in a murder case. He is involved in other case of trespassing. Learned counsel for the petitioner submits that murder case, in which petitioner was involved, was two decades old and petitioner has been acquitted in the said case. Other case is pertaining to the property disputes.
Keeping in mind the totality of circumstances, petitioner is admitted to interim bail for ten days from the date of his release, subject to his furnishing a personal bond in the sum of `25,000/- (Rupees Twenty Five Thousand Only) with one local surety in the like amount to the satisfaction of the trial court.
Petitioner shall also provide his contact number to the
Investigating Officer.
