O R D E R

The present application has been filed on behalf of the petitioner under section 483/528 BNSS (Section 439/482 CrPC) seeking interim bail in connection with FIR No. 457/2022, under Section 302 IPC and Section 25/27/54/59 of Arms Act, registered at PS-GTB Enclave. 2.

The interim bail has been sought inter alia on the grounds that the petitioner's wife is suffering from certain medical condition and the school fees of one of the children of the petitioner needs to be paid. 3.

The notice was issued in this petition vide order dated 12.11.2022 with a direction to the State to file status report. 4.

The status report has been handed over across the Bar and the same is taken on the record.

suffering from certain ailments. Further, the status report also reveals that payment of school fees of one of the children namely, Shanu Jain who is studying in class- VIII of the Rose Mary Public School, is overdue. 6.

However, at this stage, learned APP appearing on behalf of the State, points out that the prosecution evidence is underway and the material witnesses are to be examined on 17.12.2025.

Mr.Anand Vardhan Maitreya, learned counsel for the petitioner submits that the petitioner may be granted interim bail for a period of two weeks and that he will surrender before the next date fixed before the learned Trial Court.

Having regard of the facts and circumstances, the present application is allowed and the petitioner is granted interim bail for a period of two weeks from the date of release subject to the petitioner furnishing a Personal Bond in the sum of Rs. 20,000/- and one Surety Bond of the like amount to the satisfaction of the Trial Court/CJM/Duty Magistrate, further subject to the following conditions:- a) Petitioner shall provide mobile number to the IO concerned which shall be kept in working condition at all times and he shall not change the mobile number without prior intimation to the Investigating Officer concerned.

b) Petitioner shall not come in contact with the witnesses. 9.

Upon expiry of the period of two weeks as stated above, the petitioner shall surrender before the Jail Superintendent, and under all circumstances before 17.12.2025.

The petition stands disposed of.
