Petitioners have assailed order dated 16.10.2025 of the learned execution court, whereby warrants of possession were issued by the execution court. It appears that the application of the present petitioners/Judgment Debtors under Order IX Rule 13 CPC was dismissed, which dismissal was upheld by the appellate court and that order was challenged by way of a petition under Article 227 of the Constitution of India. Admittedly, in the said petition under Article 227, the execution proceedings were not stayed.

After addressing partly, learned counsel for petitioners, on instructions seeks permission to withdraw the petition with liberty to move appropriate proceedings in accordance with law. As requested, the petition and the accompanying applications are dismissed as withdrawn with liberty as sought.
