Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed by the Petitioner seeking quashing of FIR No. 0105/2019 registered under Sections 3/4 of the Delhi Medicare Service Persons & Medicare Service Institutions (Prevension of Violence & Damage to Property) Act IPC at P.S. Civil Lines and all proceedings arising therefrom in terms of the Memorandum of Understanding dated 04.05.2024. 2.

The parties are present in person in the Court and have been identified by their respective Counsel and the Investigating Officer. 3.

According to the FIR, the Petitioners had misbehaved with the Doctor, who was taking care of their relative. 4.

It is submitted that the parties have amicably resolved the dispute vide Memorandum of Understanding dated 04.05.2024. Hence, tt is prayed that the FIR No. 0105/2019 be quashed, in terms of the Settlement. The parties have endorsed the amicable settlement and accepted the terms thereof voluntarily. The parties have submitted that all the disputes have been amicably settled vide Memorandum of Understanding dated 04.05.2024 and thus, no fruitful purpose will be served in continuing with the FIR.

The present Petition has been signed by the Petitioners and is supported by their Affidavits. The parties have reaffirmed the terms of the settlement arrived at vide Memorandum of Understanding dated 04.05.2024 and they also submit that the said Settlement has been arrived at between the parties, without any pressure and coercion.

In view of the above facts that the parties have amicably resolved their differences out of their own free will and without any coercion, no useful purpose will be served in continuing with the proceedings, rather the same would create further acrimony between them. Hence, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto.

Moreover, there is no legal impediment in quashing the FIR in question.

Accordingly, FIR No. FIR No. 0105/2019 registered under Sections 3/4 of the Delhi Medicare Service Persons & Medicare Service Institutions (Prevension of Violence & Damage to Property) Act IPC at P.S. Civil Lines and all other proceedings emanating therefrom are quashed. 10.
