The present petition has been filed under Section 528 BNSS, 2023 seeking quashing of FIR No.298/2025 under Sections 3(1)(r)/3(1)(S)SC/ST (POA) ACT, 1989 & 351(3)/351(5) of BNS, registered at Police Station Shahbad Dairy, Delhi and all consequential proceedings emanating therefrom, on the ground that the parties have arrived at a settlement. 4.

The brief facts of the case are that the respondent no.2/complainant went to Rudra Property in Kishan Colony, Prahladpur Bangar along with his friends with regard to some property related issue, where a quarrel took place between the petitioner and some other person, which led to the registration of above FIR.

During pendency of the proceedings, with the intervention of the common family members, the parties have resolved all their disputes amicably without any coercion or pressure and a memorandum of understanding to that effect was executed between petitioner and respondent no.2, which is annexed as Annexure-B.

The complainant is present in Court. On a query posed by the Court, he states, he has settled the matter with the petitioner and does not wish to prosecute the criminal proceedings any further. 9.
He further states that he has no objection in case the FIR is quashed. 10.
In view of the fact that the petitioner, as well as, respondent no.2 have amicably settled their disputes and regard being had to the above statement made by the complainant, this Court is of the view that no useful purpose will be served in continuation of criminal proceedings and it will be an exercise in futility.

It is, thus, in the interest of justice that the present FIR and all the other proceedings emanating therefrom be quashed. 12.
