The matter has been taken up today for hearing as per the directions of Hon'ble the Chief Justice.

No one has appeared for the petitioner in the present matter today. Learned APP for the State points out that, the petitioner/husband is aggrieved of the impugned order dated 06.05.2010, whereby he besides his mother had been directed by the learned Trial Court to hand over the possession of the premises in question to the wife/respondent No. 2. 3.

Perusal of the record would show that although initially appearance was put on behalf of the petitioner and notice was ordered to be issued to respondent Nos. 1 and 2 and the matter has been put in the regular category, no one has cared to appear for the petitioner since 10.07.2013. 4.

This Court finds that primarily it was a matrimonial dispute between the petitioner and his wife/respondent No. 2. This appears to be a stale matter, which probably has lost its legal significance due to passage of time.
