The present petition has been filed under Section 528 BNSS, 2023 seeking quashing of FIR No.18/2019 under Sections 354/354A IPC, registered at Police Station Raja Garden and all consequential proceedings emanating therefrom, on the ground that the parties have arrived at a settlement.

The petitioner, as well as, respondent no. 2, are present in Court and they have been identified by Mr. Vimal Duggal, learned counsel for the petitioner as well as W/SI Priyanka, PS-Raja Garden Metro Station. 7.

The brief facts of the case are that a complaint of molestation and assault in a running metro was made by respondent no.2/complainant, which led to the registration of above FIR.

During the pendency of the proceedings, the parties have resolved all their disputes amicably without any coercion or pressure and a memorandum of understanding dated 12.10.2025 to that effect was executed between petitioner and respondent no.2 which is annexed as Annexure-D. 9.

The complainant is present in Court. On a query posed by the Court, she states, she has settled the matter with the petitioner and does not want to prosecute the criminal proceedings any further, and she has no objection in case the FIR is quashed.

In view of the fact that petitioner as well as respondent no.2 have amicably settled their disputes and regard being had to the statement made by complainant, this Court is of the view that no useful purpose will be served in continuation of criminal proceedings and it will be an exercise in futility.

It is, thus, in the interest of justice that the present FIR and all the other proceedings emanating therefrom be quashed. 12.

Consequently, the petition is allowed and the FIR No.18/2019 under Sections 354/354A IPC, registered at Police Station Raja Garden Metro station alongwith all other proceedings emanating therefrom, is quashed. 13.

The petition along with pending application stands disposed of in the above terms.
