The petitioner, vide the present petition under Section 25-B(8) of the Delhi Rent Control Act, 1958 (the Act) seeks setting aside of the order dated 08.07.2025 (impugned order) passed by the learned SCJ-Cum-RC, Central District, Tis Hazari Courts, Delhi, (learned ARC) whereby the eviction petition being RC ARC 488/2022 entitled "Rakesh Kumar Jain vs. Naseem Khan" of the petitioner filed under Section 14(1)(e) of the Act was rejected under Order VII rule 11(a) of the Code of Civil Procedure, 1908 (CPC) by the learned ARC.

After some arguments, learned counsel for the petitioner seeks leave to withdraw the present petition with liberty to seek recourse to appropriate proceedings in accordance with law, including initiating afresh eviction proceedings against the very same tenant qua the very same subject premises.
