This hearing has been done through hybrid mode. 2.

The present petition under Section 25-B (8) of DRC Act seeks the following prayers:- "A. Set-aside the Impugned Order Dated 30.05.2025 Passed By The Hon'ble Court Of Ms. Alka Singh, Additional Rent Controller, West, Tis Hazari Court, Delhi In Eviction Petition Bearing Arc No. 25394/16 on the ground of bonafide requirement.

B. Call the records of the Ld. Trial Court of the above noted case and examine the legality of the impugned order dated 30.05.2025 and grant leave to defend leading evidence in the eviction petition.

(c) Pass any other such orders that this Hon'ble Court may deem fit and reasonable in the interest of justice. It is prayed accordingly, Hence the present petition."

Vide order dated 18.02.2025, the learned Predecessor Bench passed the following order:- "1. Learned counsel for the parties, upon instructions from the respective tenant and landlady, submit that the parties have agreed that the tenant shall hand over the vacant, peaceful and physical possession of the subject premises to the respondent/ landlord on or before 31.03.2026, and the landlord shall not ask for any user and occupation charges from the tenant for the said period.

2. Needless to say, the tenant shall pay/ clear all electricity, water and RWA dues, including all other statutory dues qua the subject premises, and hand over all the requisite documents reflecting the payment(s) of each of the above to the landlady on or before the said date, i.e. 31.03.2026.

3. As such, learned counsel for the tenant seeks, and is granted, a period of two weeks for filing an affidavit of undertaking to the aforesaid effect.

4. Renotify on 19.01.2026."

Although the affidavit filed by the petitioner is lying under objection, however, learned counsel for the respondent confirms that the possession of the subject premises has been taken over on 31.03.3026 and also does not dispute that all the charges mentioned in para 2 of the aforesaid order has been paid.

In view of the above, learned counsel for the petitioner seeks leave to withdraw the present petition.

Leave granted.

The present petition is dismissed as withdrawn and disposed of. 8.
