% 22.08.2016 Crl.M.A. 12985/2016 Exemption allowed subject to just exceptions. Crl.M.A. 12984/2016 By this application the respondent Kiran @ Kishan seeks cancellation of the non-bailable warrants issued against him vide order dated 20th July, 2016.

Despite repeated efforts respondent was not available and thus this Court was constrained to issue non-bailable warrants. Considering the fact that the respondent Kiran has furnished his address and telephone number and vakalatnama of Mr. Abhimanyu Singla, Advocate has been filed, nonbailable warrants issued against Kiran @ Kishan are recalled. Application is disposed of.

Considering the evidence on record it is a fit case where leave to appeal is required to be granted. Granting leave to appeal to the State, present petition is disposed of.

To ensure the presence of the respondent the respondent Kiran @ Kishan will furnish a personal bond in the sum of `25,000/- with one surety of the like amount subject to the satisfaction of the Registrar General of this Court within two weeks.
