The present petition under Section 24 read with Section 151 of the CPC, 1908, seeks the following prayers: - "a) Direct the transfer of Civil Suit No. CS SCJ 642/2023 (Jagdish v. Deepak Kumar & Anr.), presently pending before the Hon'ble Rohini Courts, Delhi, to the Hon'ble Tis Hazari Courts, Delhi, or any other competent Court in Delhi, in the interest of justice, convenience, and to secure a fair and impartial adjudication; b) Pending the decision of this Transfer Petition, stay all further proceedings in Civil Suit No. CS SCJ 642/2023 (Jagdish v. Deepak Kumar & Anr.), presently pending before the Hon'ble Rohini Courts, including any coercive orders or adverse steps, so as to prevent prejudice to the rights and safety of the Petitioner and to secure the ends of justice;

d) And to pass such other and further orders as this Hon'ble Court may deem just, necessary, and proper in the facts and circumstances of the case, including but not limited to any directions to ensure the safety, protection, and security of the Petitioner and his father, to safeguard their right to a fair trial, and to provide any interim or ancillary relief which this Hon'ble Court may consider appropriate in the interest of justice." 3.

Vide order dated 12.11.2025, the learned Predecessor Bench of this Court, on the statement made on behalf of the learned counsel for the petitioner, had observed that the petitioner is restricting his claim to prayers (a) and (b) only, and accordingly, notice was issued. 4.

Respondent no. 1 appears in person and submits that he has no objection if the aforesaid prayers (a) and (b) in the present petition are allowed.

Learned counsel appearing on behalf of the respondent no. 2 submits that without admitting the contents of the petition and without prejudice to her rights and contentions, he has no objection if the civil suit, CS SCJ 642/2023 (Jagdish v. Deepak Kumar & Anr.), is transferred from Rohini Courts, Delhi, to the learned concerned Court in Tis Hazari Courts, Delhi. 6.

In view of the averments made and in the interest of justice, the present petition is allowed and civil suit, CS SCJ 642/2023, pending before the Rohini Courts, is transferred to the learned Principal District & Sessions Judge, Headquarters, Tis Hazari Courts, Delhi, who shall assign the said suit to a Court of competent jurisdiction. Let the records of the said civil suit be transferred to the concerned learned Court within a period of 10 days. Parties are directed to appear before the concerned learned Court accordingly.
