Heard the learned counsel for the parties.

The prayer made in this Public Interest Litigation petition prays to direct respondent nos.1 to 4 to restrain respondents no. 5 to 9 from creating any hindrance, obstructions, nuisance in using the subject land as Kabristan. 3.
The respondent nos.5 to 9 against whom prayer is made are private respondents and as a matter of fact and law as well, petitioner would be better advised to institute a suit seeking injunction or any other appropriate remedy before a Competent Court of civil jurisdiction. Accordingly, without entering into the merit of the claim of the parties, this petition is disposed of with the liberty to the petitioner to institute an appropriate suit before a Court of competent civil jurisdiction. If any such suit is instituted, the proceedings thereof shall be expedited and in case any application seeking interim injunction is also moved and is accompanied by the suit, the same shall also be considered and decided by the Court concerned as expeditiously as possible. The writ petition stands disposed of in the aforesaid terms.
