The present petition has been filed under Section 57 of the Trade Marks Act, 1999 seeking removal/cancellation of the impugned mark "
" bearing application no.5671320 in class 5.

Notice in the petition was issued on 4th December, 2024, and an ad interim order was passed in terms of which the registration of the impugned mark "
" was stayed.

On the last date of hearing i.e., on 26th March, 2025, counsel for respondent no.1 was asked to take instructions. Counsel for respondent no.1 has returned with instructions and submits that respondent no.1 has neither C.O. used the impugned mark nor has any intention to use it in future. Therefore, it has no objection if the impugned mark is removed from the Register of Trade Marks.

Accordingly, the petition is allowed and Trade Marks Registry is directed to cancel and remove the entry in respect of the impugned mark from the Register of Trade Marks.

The Registry is directed to supply a copy of the present order to the Trade Marks Registry, at e-mail: llc-ipo@gov.in, for compliance. 6.
All pending applications stand disposed of.
