Heard the learned counsel for the appellant as well as the learned counsel for the respondent No.3/Statesman Mazdoor Union. 2.

Having regard to the fact that the amount deposited by the appellant has been kept in FDR and more particularly that the writ petition stands posted to 26.04.2017, we find force in the submission of the learned counsel for the appellant that the direction to refund the amount in deposit together with interest is not warranted at this stage. 3.

Instead it would be appropriate to dispose of the main petition itself expeditiously.

Accordingly, we request the learned Single Judge to dispose of the main writ petition itself on 26.04.2017 or any other convenient date as expeditiously as possible.

LPA 162/2017

The order under appeal to the extent of direction to refund the amount in deposit shall stand set aside.

The appeal is accordingly disposed of.
