The present petition under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 seeks a direction to the Respondents to remove the name of the Petitioner from the roll/register of Bad Characters.

The Petitioner asserts that the continued retention of his name in the Bad Character Roll is unjustified and adversely affects his reputation and business interests. He submits that he is a Class-I Government contractor engaged with several departments of the Government of NCT of Delhi, and that he has not been involved in any criminal case for the past six years. He contends that, despite this, his name continues to remain on the register without any valid basis.

It is submitted that, in view of the above, there is no subsisting material that would warrant the Petitioner's continued classification as a Bad Character, particularly as no fresh FIR has been registered against him in six years.

Mr. Sanjeev Bhandari, ASC (Crl.) for the State, submits that the Petitioner's name was downgraded from Bundle A to Bundle B on 23rd September, 2025, pursuant to a review conducted by the DCP. He submits that the Bad Character Roll is subject to periodic review and the Petitioner's name shall be reconsidered in the next cycle in accordance with law. 6.
Considering that one review has already resulted in a downgrade and that a period of six years has elapsed since the Petitioner's last alleged involvement, a direction is issued to the State to undertake a further review of the Petitioner's antecedents and take appropriate action in accordance with law within a period of three weeks from today. 7.
With the above direction, the petition along with pending applications stands disposed of.
