The present Petition has been filed by the Petitioners under Section 115 of the Code of Civil Procedure, 1908 [hereinafter referred to as 'CPC'] seeking to challenge an order dated 12.09.2024 passed by Ld. Commercial District Judge, Central, Tis Hazari Courts, Delhi [hereinafter referred to as 'Impugned Order']. By the Impugned Order, an Application under Order XII Rule 6 of the CPC filed by the Petitioners has been dismissed. 2.

Learned Counsel for the Petitioners submits that he limits his contentions in the present Petition to a direction that the findings in the order dated 12.09.2024 passed by the learned Trial Court shall not come in the way of the Petitioners' defence before the learned Trial Court. 3.

Learned Counsel for the Respondent fairly submits that he has no objection to this, since these findings are in any event, interim in nature. 4.

interim order, it is clarified that the findings in this order shall not come in the way of the final adjudication of the matter between the parties. The rights and contentions of both the parties are left open to be agitated before the learned Trial Court.
