After some hearing, Mr. Sunil Prakash Pandey, learned counsel for the petitioner, seeks permission to withdraw this application at this stage, without prejudice to his rights to move the Sessions Court at an appropriate stage.

However, Mr. Pandey points out that by an order dated 07.05.2024, while dismissing an earlier bail application filed by the petitioner [BAIL.APPLN. 1030/2024], this Court had directed as follows: "12. At the same time, it is noticed that the Applicant has been in custody for almost five years and the trial has not progressed. Evidence of only one witness has been recorded. The learned Trial Court is, therefore, requested to expedite the trial and make an endeavour to dispose it of within a period of one year from the first listing of the trial before it post this order. He submits that despite the passage of considerable time, the trial has not progressed, and the matter is fixed before the Sessions Court for examination of the wife of the deceased for a considerable time. 3.

In view of the above, Mr. Pandey submits that the petitioner reserves his right to move the Sessions Court upon conclusion of the evidence of material witnesses, and/or after a reasonable period if the trial does not progress further.

The petition is dismissed as withdrawn, in terms of the above submissions.

It is made clear that this Court has not made any observations on the merits of any future application that the petitioner may file, which is for the Sessions Court to consider, in accordance with law.
