O R D E R

By way of present petition filed under Article 226 of the Constitution, the petitioner seeks grant of parole for a period of 60 days in a case arising out of FIR No.294/2008, under Sections 302/201/506/376 IPC registered at Police Station Bawana, Delhi, on account of marriage of his daughter which is going to be solemnized on 10.12.2024. The petition is accompanied by the marriage card of his daughter.

Notice is accepted by learned Standing Counsel (Crl.) for the State, who hands over a copy of the Status Report, which is taken on record. 4.
Learned counsel for the petitioner submits that the petitioner has been convicted in the context of the aforesaid FIR and he was awarded life sentence. It is further submitted that the petitioner has already undergone 15 years and 23 days of incarceration as per Nominal Roll dated 09.10.2023. earlier release of the petitioner, last being furlough granted for three weeks with effect from 08.08.2023 to 30.08.2023, by the DG (Prisons). 5.
The Status Report states that the factum of marriage of the petitioner's daughter has been verified and in this regard, statements of sister-in-law and one neighbour has also been recorded. Learned Standing Counsel (Crl.) for the State submits, on instructions, that telephonic verification has also been made from the prospective groom, who has also stated to the same effect. 6.
Considering the aforesaid, including the factum of marriage of the petitioner's daughter being duly verified, the present petition is allowed and the petitioner is granted parole for a period of two weeks which will be effected from the date of his release, subject to the following conditions: (i) The petitioner shall furnish a personal bond in the sum of Rs.10,000/- to the satisfaction of the concerned Jail Superintendent/learned Trial Court/Duty JMFC.
(ii) The petitioner shall report to the SHO, PS Bawana, Delhi on every Friday during the period of his release.
(iii) The petitioner shall surrender before the concerned Jail Superintendent after the expiry of two weeks from his release. 7.
The petition is disposed of in the above terms. 8.
A copy of this order be electronically communicated to the concerned Jail Superintendent as well as to the learned Trial Court for information and necessary compliance.
