The petitioner is defending a commercial suit and is aggrieved by order dated 24.08.2024, whereby the application moved by the defendant seeking condonation of delay in filing written statement as well as order of review dated 09.02.2024 were dismissed, being without any merit. The defendants i.e. petitioners herein, were admittedly served by way of publication. 2.

However, learned counsel for the petitioner has, at the very outset, apprised that the present petition has become infructuous as the suit in question has already been withdrawn by the concerned plaintiff i.e. Mr. Itesh Bhardwaj on 20.02.2025. A copy of such order has also been shown during the course of arguments and the same has been directed to be retained on record.

Evidently, in view of the fact that the suit has already been withdrawn by the plaintiff, the present petition has become infructuous and the same is accordingly disposed of.
