W.P.(CRL) 839/2016 The present is a petition under Article 226 of the Constitution of India read with Section 482 of the Code of Criminal Procedure, 1973, seeking a direction to the police to provide adequate protection to both the petitioners at House No.279, Dhaka Johar, near Bhai Permanand Colony, Mukherjee Nagar, New Delhi- 110009.
The petitioners, who are a young newly-wed couple, are stated to be permanent residents of Haryana. The petitioners, who are both adults, have solemnized their marriage of their own free will and desire on 23.01.2016 at the Arya Samaj Mandir Trust, Khanna Market, Tis Hazari, Delhi- 110054. The petitioners apprehend threats to their life and limb at the hands of the relatives of petitioner No.2 for having entered into the marriage against their wishes. The
petitioners have since fled from their native place in Haryana and resettled in Delhi.
Notice.
Ms Richa Kapoor, learned Addl. Standing Counsel (Crl.), accepts notice on behalf of the official respondent and states that in view of the foregoing facts and circumstances, the police shall afford adequate protection to the petitioners. The beat constable of the concerned area shall also be sensitized in this behalf. The telephone numbers of the SHO of the concerned police station as well as the beat constable shall be provided to the petitioners in order to enable them to contact the police in the event of any threat or apprehension. Directed accordingly.
In view of the direction that has been issued and since no relief has been prayed for against respondent Nos.4 to 6, in my view it is neither just nor necessary to issue notice to them.
With the above direction the writ petition is allowed and disposed of accordingly.
