% 03.04.2018 Notice.

Learned proxy counsel for the learned ASC accepts notice. By this petition, the petitioner seeks parole on the ground that he has to build toilet at his home for his paralysed mother and to maintain social ties.

A status report has been handed over by the State which is taken on record. As per the status report it has been verified that the mother of the petitioner Smt. Godambari Devi aged 59 years is paralysed and residing alone at the house in village Thapulla Malla, Post, Kasani Police Station Satpoli, District Puodi Garhwal (Uttra Khand). The family of the petitioner W.P.(CRL) 922/2018

comprises of his mother and younger brother whose whereabouts are not known for the last twenty years.

Considering the ailment of the petitioner's mother, that part construction of toilet has been done and also that the petitioner was also granted parole by the Government of NCT Delhi for a period of two weeks w.e.f. 23rd May, 2017 and there is no allegation that during the period of parole the petitioner misused the concession granted to him, this court deems it fit to grant parole to the petitioner. It is therefore directed that the petitioner be release on parole for a period of four weeks from the date of his release on his furnishing a personal bond in the sum of ₹25,000/- with one surety of the like amount, to the satisfaction Superintendent, Mandoli Jail.

Petition is disposed of.

Copy of this order be communicated to the petitioner through Superintendent, Mandoli Jail.
