W.P.(C) 2040/2016 & CM No.8775/2016 The petitioner has filed the present petition under Article 226 of the Constitution of India seeking following prayers:- "(i) Issue writ of certiorari and/or any other writ or writs or any appropriate orders or directions to the respondents to stay to pass any adverse order or issue any coercive notice to the petitioner unless the procedure as directed by the Hon'ble High Court of Delhi vide its orders dated 12.06.2015, 19.08.2015 and 25.08.2015 under W.P.(C) 5984/2015, W.P.(C) 7825/2015 and LPA 562/2015 are followed and unless all the material inputs are supplied to the petitioner and unless final report of the CBI enquiry in concluded in the matter.
(ii) Set aside the show cause notice dated 29.05.2015 and enquiry proceedings initiated against the petitioner by the respondents being illegal and improper.
(iii) Call for the service record and Enquiry proceedings against the Petitioner in the power and possession of the Respondents."
Learned counsel for the petitioner submits that show-cause notice dated 29.05.2015 was issued by respondent No.1 to petitioner. The petitioner challenged the said show cause notice by filing W.P.(C) No.5984/2015.
Vide order dated 12.06.2015, the said petition was disposed of by this Court. On 10.08.2015, the petitioner sent a reply to the show cause notice dated 29.05.2015 and requested respondent No.1 to supply the requisite documents mentioned in the said reply. The said reply was followed by letter dated 13.08.2015 and 18.08.2015, however, the respondents did not supply the requisite documents to the petitioner.
Learned counsel for the petitioner also submits that the petitioner filed petition bearing W.P.(C) No.7825/2015 challenging the constitution of the committee. Vide order dated 19.08.2015, the said petition was disposed of. Against the said order, the petitioner preferred an appeal bearing LPA No.562/2015 which was dismissed by the Hon'ble Division Bench vide order dated 25.08.2015. Learned counsel for the petitioner further submits that the respondents has not supplied copy of requisite documents as mentioned in the letter dated 10.08.2015 till date.
At this stage, Mr.Mohinder J.S. Rupal, learned counsel for the petitioner submits that the petitioner has received an e-mail dated 08.03.2016 enclosing letter dated 04.03.2016 whereby it has been informed that the proceedings have been concluded. Learned counsel for the petitioner seeks permission to withdraw the present petition as well as application with liberty to challenge letter dated 04.03.2016. As prayed, the petition as well as application are dismissed as withdrawn.
