O R D E R

This is an petition seeking interim bail to the petitioner for a period of 45 days in FIR No. 383/2016, under Sections 302/120-B/34 IPC and Sections 25/27/54/59 Arms Act registered at PS Jyoti Nagar, on the ground that the marriage of the daughter of the petitioner is stated to be on 22.12.2024.

Ms. Dalal, learned APP has filed a status report, wherein the factum of marriage has been verified.

As per the Nominal Roll dated 12.12.2024, the petitioner has already undergone 3 years 4 months and 29 days of incarceration. 4.
The conduct of the petitioner in jail has been shown to be satisfactory. 5.
For the said reasons, I am inclined to allow the petition. 6.
The petition is allowed and the petitioner is directed to be released on interim bail for a period of 10 days from 16.12.2024 to 25.12.2024 in FIR No. 383/2016 registered at PS Jyoti Nagar subject to the following terms and conditions:

i. The petitioner shall furnish a personal bond in the sum of Rs. 10,000/- (Rupees Ten Thousand Only) with one surety of the like amount to the satisfaction of the concerned Trial Court; ii. The petitioner shall appear before the concerned Court as and when the matter is taken up for hearing;
iii. The petitioner shall provide his mobile number to the concerned IO, which shall be kept in working condition and switched on at all times. In case of change of residential address or contact details, the petitioner shall promptly inform the same to the concerned IO as well as to the concerned Court;
iv. The petitioner shall not leave the NCT of Delhi without permission of the concerned Court during the bail period and surrender his passport, if any, at the time of release before the concerned Court; v. The petitioner shall not directly/indirectly try to get in touch with any prosecution witnesses or tamper with the evidence. 7.
The petition stands disposed of in the aforesaid terms. 8.
