% 28.04.2017 By the present petition the petitioner seeks anticipatory bail in FIR No. 167/2014 registered under Section 420 IPC at PS Barakhamba Road on the complaint of respondent No.2.
A status report has been filed pursuant to the notice issued. The allegations against the petitioner and other accused in the above-noted FIR relate to the petitioner posing himself as Chairman of a political party of Himachal Pradesh and assuring jobs for the daughter and son of the complainant. It is alleged that on the said pretext a total sum of ₹50 lakhs BAIL APPLN. 561/2017
was paid. A perusal of the status reveals that vide order dated 5th April, 2017 the petitioner has already been declared a proclaimed offender in the above-noted FIR.
In view of the decisions of the Supreme Court reported as 2012 (8) SCC 730 Lavesh vs. State (NCT of Delhi) and 2014 (2) SCC 171 State of M.P. vs. Pradeep Sharma, no anticipatory bail can be granted to the petitioner.
Bail application is dismissed .
