The present appeal under Section 96 of the CPC, seeks the following prayers: - "In view of the above facts, submissions and grounds, it is therefore most respectfully prayed that the order dated 03/05/2010, passed by the court of Sh.D.C.Anand, ADJ, Delhi may kindly be set aside/ quashed and the suit of the appellant/plaintiff for declaration, permanent and mandatory injunction be decided on merits in the interest of justice.

Such other and further order (s) or direction (s) as deemed fit and proper in the facts and circumstances of the case may kindly be passed in favour of the appellant and against the respondents.." 3.

parties vide order dated 28.04.2025 passed by the learned Predecessor Bench, and report with regard to the same reflects that a statement of the appellant had been recorded, wherein she has stated that matter has been settled between the parties, 10 years ago. Learned counsel appearing on behalf of respondent no. 2 confirms the same.

In view of the above, the present appeal is dismissed in default for nonprosecution and disposed of accordingly. 7.
