% 05.12.2024 1.
This petition has been filed seeking quashing of FIR No.272/2014 under Sections 498A/506/34 IPC and Sections 3 & 4 D.P. Act, registered at P.S Parliament Street, on the basis of a settlement arrived at between parties, as per which Rs.19 lakhs had to be paid to respondent no.2. 2.
Respondent No. 2 is present in the Court and states that she has received the settlement amount and has no objection to quashing the FIR. 3.
Petitioner is also present in Court and is duly identified by IO and the counsel.
4.
Marriage of petitioner no.1 and respondent no. 2 resulted in a divorce by decree dated 14th October 2016. No child was born out of wedlock. 5.
Considering the above settlement between the parties and the chances of conviction of the petitioners being remote and bleak, there is no use continuing with proceedings of the present FIR as it would be a misuse of the process of the Court and an unnecessary burden on the State exchequer.
